Justice O'Donnell wrote in R v Novielli 2015:

"Discretion is an essential feature of any judicial system. That is because criminal cases are not one-size-fits-all widgets and complainants, defendants and witnesses are human beings, who come in all shapes, sizes, personalities, strengths, weaknesses and backgrounds. Tailor-made outcomes will generally be more just than outcomes unduly constrained by artificial and inflexible external rules." [ - paragraph 33]
